Terms and Conditions

1. General

These general terms and conditions apply to all products and services of Photo's by Fleur Maartje.

When purchasing products and services, you automatically agree to these conditions. If you object to these conditions, you can only make this known in writing and prior to the report.

These general terms and conditions can be adjusted by Photo's by Fleur Maartje at any time.

2. Reports

A report is only recorded when you have received confirmation, which means a WhatsApp message with the following information: Date, time, cost agreement, location and general terms and conditions.

chooses a particular photographer because the style of this photographer appeals to you. Photos by Fleur Maartje is free to apply her artistic knowledge and insight in the photo report.

The photos are delivered via Pixieset. More information about this can be found on the website at: photo delivery. (please note that you are entitled to the amount of photos included in your package) (but you do have a free choice of many images from your report) (additional photos are 9.95 each)

A selection of photos/videos is made from each report. Photo's by Fleur Maartje will make a selection of the best photos/videos in its opinion, so that the style of Photo's by Fleur Maartje is captured in the report. You cannot in any way rely on photos that are not suitable for display according to Photo's by Fleur Maartje.

All unedited photos are kept for a maximum of 6 weeks, after which they are destroyed.

If the report is on location, everything must be ready to start immediately. If this is not the case, additional costs may be charged.

Edited Photos and Videos are actively stored by Photo's by Fleur Maartje for a maximum of 2 months. After that it is no longer possible to place subsequent orders. (Reorders include all types of wall decoration and photo books.) The edited images are still stored at an external location so that you can call on these photos in an emergency.

There is no maximum number of photos for the reports. The minimum number of photos you will receive is always 15 photos.

If the weather forecast is bad, a decision will be made no more than half an hour before the outdoor shoot whether it will go ahead. If it rains (even drizzling rain), the photo shoot will not take place and will be moved free of charge.

Photos always remain in the possession of Photo's by Fleur Maartje. Specifically for agricultural photography, this means that the photos may be sold by photo's by Fleur Maartje to third parties. You can purchase this right at the photo shoot.

Travel costs are not included in the price and amount to 0.41 cents per km calculated from studio location. Or if the travel time is longer than 5 hours, any flight costs and car rental will be charged.

3. Payment, Delivery time & Complaints

You will receive all photos within a maximum of 20 working days unless otherwise stated in advance.

For weddings, a 25% deposit is required if this is not paid within 2 weeks, the wedding reservation will be cancelled.

The payment term for your invoice is 14 days, unless otherwise agreed. If you have not paid the amount due or have not paid it in full within the payment term, you will receive a reminder once. If this has not been paid after 14 days, you will receive a new invoice with a 25 euro payment fine.

For products such as photo books, etc., Photo's by Fleur Maartje is dependent on the delivery time of third parties. As a result, an adjusted delivery time applies.

Your photo report and your photos have been taken personally for you, which is why refunds of money are unfortunately not possible under any circumstances.

Reports are kept by photo's by Fleur Maartje for a maximum of 3 months after delivery, after which you can no longer rely on this! (you can never use raw images)

Complaints regarding the work delivered must be reported in writing to Photo's by Fleur Maartje as soon as possible, but in any case within 5 working days after delivery of the photos.

Photos by Fleur Maartje has the right to deliver good work for rejected work within a reasonable period.

You are responsible and liable for yourself and your property during the photo report. In the broadest sense of the word, damage to yourself, your property and others cannot in any way be recovered from Photos by Fleur Maartje.

Photos by Fleur Maartje is registered with the KOR (the small business scheme), which means that no VAT is added to the invoice amount. For companies, this also means that no tax can be claimed back.

Canceling the report must be done in writing at least 7 days in advance. If the cancellation takes place within these 7 days, €75 will be charged.

All prices mentioned on the website and photo products such as wall decoration, photo books and prints are without VAT. VAT is only included on the invoice.

4. Copyrights & Publications

Copyright (and other rights attributed to Photo's by Fleur Maartje by Dutch law) of all reports always remain in the possession of Photo's by Fleur Maartje.

When you book a shoot you automatically agree to the publication rights.

Photos by Fleur Maartje may use and publish the photos and videos at its own discretion at any time for both non-commercial and commercial purposes. Photos by Fleur Maartje is not obliged to report this to the owner. If you wish to object to this, you can do so by means of a written statement. before the report takes place. Or when a photo has been posted.
